ביום 23/1/17 התקיים קדם משפט בתביעת האבות הגרושים מישראל התובעים בבית המשפט הפדרלי בניו יורק, נגד רשמי ההוצאה לפועל ושופטים מבתי המשפט בישראל. על הפרק האשמת שופטים ורשמים ישראלים כמשתפי פעולה במנגנון דיכוי האבות באפרטהייד מגדרי נגד גברים, ושוד מזונות המתבצע בהוצאה לפועל ע”י מדינת ישראל, כולל נעמ”ת, ויצ”ו, והסוכנות היהודית. התיק מנוהל ע”י השופט ויליאם פאולי. קדם משפט נוסף צפוי להתקיים ביום 22/6/2017. בדיון קדם משפט שהתקיים היום, התובעים הישראלים התייצבו באמצעות וידיאו-צ’אט שהתקיים בארץ, היות ומדינת ישראל סירבה לבטל את עיכוב היציאה נגדם ולאפשר להם לנכוח במשפט. נקבע קדם משפט נוסף לדיון בבקשה למחיקה על הסף שהנתבעים הודיעו שיגישו. הדיון יתקיים ב 22/6/2017.

כתב התביעה מתוקן, הוגש בתאריך 26/1/2017 שלושה ימים לאחר שהתקיים קדם משפט טלפוני בתאריך 23/1/2017 בפני השופט פאולי, מכיוון שמדינת ישראל לא הסכימה לבטל עיכוב יציאה נגד התובעים המתגוררים בישראל, ואשר לגביהם קיים צו עיכוב יציאה עקב תיקי מזונות המתנהלים בלשכת הוצל”פ. השופט פאולי קיבל את ההסבר והתיר להם להתייצב באמצעות טלפון מישראל.
בקשת התובעים לאשר להם התייצבות בקדם משפט בטלפון, מאחר ומדינת ישראל מונעת מהם לצאת לארה”ב להתייצב במשפט באמצעות צו עיכוב יציאה. השופט אישר לתובעים להתייצב באמצעו טלפון. בישראל זה לא היה קורה. שופט ישראלי היה מוציא התראה שאם התובעים מחו”ל לא יתייצבו, התביעה תימחק, ואם התובעים כן היו מגיעים לישראל, מייד היה מוציא נגדם עיכוב יציאה, והם היו מושלכים למעצר או כלא. זה ההבדל בין הדמוקרטיה האמריקאית, והדיקטטוטרה השיפוטית ישראלית.

עוה”ד של הנתבעים הישראלים מהוצאה לפועל מפנים במכתבם לתביעות קודמות של שרון בן חיים (נגד עדנה ארבל, ג’מילה ג’בארין כליפא, דניאל אדרי ועוד), יעקב בן יששכר נגד נתן נחמני ומיכל ברק נבו, מריגולד קולינס באוקלהומה נגד טובה פרי, גלית מור ויגוצקי ויצחק עמית, נירית יעקובסון בקליפורניה נגד שפרה גליק, ואיתן אליהו בקליפורניה נגד נפתלי שילה. השופט פאולי אישר להם להגדיל את כמות העמודים של בקשתם למחיקה על הסף עד 40 עמודים, וכך גם לתובעים שבתיק זה.
